These General Terms and Conditions (“Terms”) govern the use of the website travent.ch and all transportation services arranged by Travent GmbH. Please read them carefully before you send us a booking request.
1. Scope
1.1 These Terms apply to all transportation services arranged by Travent, in particular chauffeur services, event transportation, airport and rail transfers, daily disposal, standby services and group transportation (“Transport Services”), regardless of whether they are requested via our website, by email, by phone or in writing. They also apply to the transport contracts arranged by Travent, unless mandatory provisions applicable to the Transport Provider take precedence.
1.2 Our Booking Conditions form an integral part of these Terms. Where an individual offer or written agreement deviates from these Terms or the Booking Conditions, the individual offer or agreement prevails.
1.3 Any general terms and conditions of the customer do not apply, even if Travent does not expressly object to them.
2. Provider
Travent GmbH, Rauracherstrasse 33, 4125 Riehen, Switzerland. Company ID (UID): CHE-321.381.910. Email: info@travent.ch, phone: +41 76 611 40 79 (“Travent”, “we”, “us”).
3. Role of Travent
3.1 Travent is a broker for chauffeur and transportation services. We arrange Transport Services that are performed by independent, licensed transport companies and their chauffeurs (“Transport Providers”). Travent does not perform any transportation itself and is not a carrier.
3.2 The contract for the transportation itself (“Transport Contract”) is concluded between the customer and the Transport Provider; Travent arranges this contract. In addition, Travent coordinates the planning, communication with the Transport Provider, event accreditation and invoicing, and remains your point of contact for all questions about your booking.
3.3 Transport Providers and their chauffeurs act independently. They are neither employees nor vicarious agents of Travent.
3.4 Vehicle images and descriptions on our website illustrate the vehicle class. The Transport Provider may provide a vehicle of the same or a higher class.
4. Customers and passengers
4.1 Bookings may be made by individuals with full legal capacity as well as by companies, organisations and public bodies acting through authorised representatives.
4.2 Whoever makes a booking (“Customer”) is responsible for payment, even if the Transport Services are used by other passengers. The Customer ensures that all passengers are informed of and comply with these Terms and the Booking Conditions.
5. Booking and confirmation
5.1 Information on our website, including vehicle availability, is non-binding. A request sent via our website forms, by email or by phone is a non-binding booking request.
5.2 After receiving your request, we send you an offer and an invoice. A booking is only confirmed, and the Transport Contract is only concluded, once the full payment has been received and we have confirmed the booking in writing (email is sufficient).
5.3 Last-minute requests, in particular for transfers, are confirmed subject to availability.
5.4 You are responsible for providing correct and complete information, such as pick-up times and addresses, flight or train numbers, number of passengers and luggage, and contact details. Please inform us of any changes without delay.
6. Prices and payment
6.1 Prices are stated in Swiss francs (CHF) unless otherwise agreed. Our offer states whether value added tax is included or shown separately. All kilometres are included in our prices.
6.2 All bookings require prepayment. Invoices are payable within 7 days of the invoice date and in any case before the first day of service. Bookings that have not been paid are not confirmed.
6.3 Travent collects all payments for the Transport Services. The Transport Provider assigns its payment claims to Travent; payment to Travent discharges your obligation towards the Transport Provider.
6.4 Additional costs, such as additional hours or extra waiting time, are charged in accordance with the Booking Conditions and are payable within 7 days of the invoice date.
6.5 If payment is late, the Customer is in default without further reminder and owes default interest of 5% per year.
7. Changes and cancellations
Changes to a confirmed booking require our confirmation. Cancellations are governed by the Booking Conditions or the cancellation terms stated in the individual offer.
8. Conduct in the vehicle
8.1 Passengers must follow the chauffeur’s safety instructions and the rules in the vehicle set out in the Booking Conditions.
8.2 The Customer is liable for damage to the vehicle and for exceptional soiling caused by passengers, including the costs of repair, cleaning and loss of use.
9. Liability
9.1 The Transport Provider is liable for the performance of the transportation in accordance with the Transport Contract, the statutory provisions and its mandatory motor vehicle liability insurance.
9.2 Travent is liable for the careful selection of Transport Providers and the correct transmission of your booking details. Travent is liable for damage caused intentionally or through gross negligence. To the extent permitted by law, liability for slight negligence is excluded. Travent is not liable for the performance of the transportation by the Transport Provider.
9.3 Neither Travent nor the Transport Provider is liable for delays or changes caused by circumstances beyond their control, such as traffic, weather, road closures, security checks or official measures, in particular during major events. Missed flights, trains, appointments and other consequential losses are excluded unless caused intentionally or through gross negligence. Please plan your journey with sufficient time.
9.4 Passengers are responsible for their personal belongings. We will make reasonable efforts to help return items left in a vehicle.
10. Force majeure
If events beyond reasonable control make the Transport Services impossible or unreasonably difficult, such as natural events, extreme weather, epidemics, strikes, official orders or failures of infrastructure, Travent and the Transport Provider are released from their obligations for the duration of the event. We will inform you without delay and, where possible, propose an alternative.
11. Data protection
We process personal data in accordance with the Swiss Federal Act on Data Protection and, where applicable, the EU General Data Protection Regulation. Details can be found in our Privacy Policy.
12. Changes to these Terms
We may update these Terms with effect for the future. The version published on our website at the time of your booking applies to that booking.
13. Severability
Should any provision of these Terms be or become invalid, the validity of the remaining provisions is not affected. The invalid provision shall be replaced by a valid provision that comes as close as possible to its economic purpose.
14. Applicable law and place of jurisdiction
14.1 These Terms and all contracts with Travent are governed by Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG) and the rules of private international law.
14.2 The exclusive place of jurisdiction is Basel, Switzerland. Mandatory places of jurisdiction for consumers remain reserved.
